No.91

　　In order to meet the needs of the parties in their economic and legal activities for patent-related certification documents, China National Intellectual Property Administration has formulated a new version of three certification documents: Copy of Patent Register, Certificate and Patent Description. The relevant enabling matters are hereby announced as follows.

　　First, the new version of the certificate has been in use since July 1, 2003. Since the same day, China National Intellectual Property Administration will no longer use the original version of the certificate; All kinds of old certificates issued by China National Intellectual Property Administration before June 30, 2003 (including that day) still have the prescribed effect after July 1, 2003 and will not be replaced.

　　Two, the "copy of the patent register" is a certificate made according to the patent register set up in China National Intellectual Property Administration, which is used to record the matters stipulated in Article 88 of the Detailed Rules for the Implementation of the Patent Law of People’s Republic of China (PRC). According to Article 117 of the Detailed Rules for the Implementation of the Patent Law of People’s Republic of China (PRC), anyone can request China National Intellectual Property Administration to issue a copy of the Patent Register from the date when the patent application is announced to grant the patent right.
　　"Certificate" is used to prove the fact that China National Intellectual Property Administration once issued a patent certificate, and to record the time when China National Intellectual Property Administration issued the relevant patent certificate and the related matters of the patents involved. Due to the loss of patent certificate, transfer of patent right or other legal reasons, the patentee (including the original patentee whose patent right has been terminated or transferred) may request China National Intellectual Property Administration to issue a Certificate.
　　The Patent Specification is a copy of the announcement text of the invention or utility model patent, which mainly contains the authorized claims and specifications (including the attached drawings, if any). For the purpose of short-term registration in Hongkong or other purposes permitted by laws and regulations, the patentee may request China National Intellectual Property Administration to issue a Patent Description.

　　3. In addition to meeting the requirements of this announcement, the unit or individual who requests the China National Intellectual Property Administration to handle the above-mentioned certification documents shall also submit the certificate or personal identification documents issued by the unit and other documents that should be submitted in accordance with laws, regulations and administrative rules; If it is handled by others, the original power of attorney issued by the parties shall be submitted.

　　Four, according to the provisions of Article 68 of the Patent Law of People’s Republic of China (PRC), the fees shall be paid in accordance with the provisions for handling the above documents.

　　Five, the request for the above documents shall follow the standard format and be filled in Chinese.

　　6. The request and fees for handling the above supporting documents can be delivered in person or sent to: General Office of Preliminary Examination and Process Management Department of China National Intellectual Property Administration Patent Office, No.6 Xitucheng Road, Haidian District, Beijing (postcode 100088).

　　Seven, three new versions of the documents are attached.
